Terms of Service

Welcome to The Sitters Club. These Terms of Service (“Terms”) govern your access to and use of the website and services (the “Service”) operated by The Sitters Club LLC (“we,” “us,” or the “Club”). By creating an account, applying, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. What the Club is (and is not)

The Club is a membership platform that introduces approved families (“Parents”) to independent babysitters (“Sitters”) and provides scheduling and booking tools. The Club is not a childcare provider, employment agency, or the employer of any Sitter. Sitters are independent individuals, not employees or agents of the Club. We do not direct, supervise, or control the childcare Sitters provide, and we do not guarantee the availability, conduct, or suitability of any Sitter or Parent.

2. Eligibility and membership

• You must be at least 18 years old and able to enter a binding contract.
• Membership requires an application and approval. We may interview, screen, verify, approve, decline, suspend, or remove any member at our discretion.
• You agree to provide accurate information and keep it current.

3. Screening and vetting

We may interview Sitters and, where indicated, perform identity or background checks. Any such screening is limited, is not a guarantee, and should not be relied on as a complete assessment of a person’s fitness or safety. Parents remain responsible for interviewing and deciding whether to entrust their children to any Sitter, and Sitters remain responsible for deciding whether to accept a booking.

4. Fees and payments

• Parents pay a recurring membership subscription and a per-booking fee, charged through our payment processor (Stripe) to the payment method on file.
• Sitters are paid their hourly rate directly by the Parent. The Club does not collect, hold, or disburse Sitter wages and is not responsible for those payments.
• Fees are described in the Service and may change on notice. Except where required by law or expressly stated, fees are non-refundable.

5. Bookings and cancellations

When a Parent books an available time, a booking is created between the Parent and the Sitter. The Club is not a party to that arrangement and is not responsible for cancellations, no-shows, or disputes between members.

6. User conduct

• Use the Service only for its intended, lawful purpose.
• Do not misrepresent yourself, harass others, or arrange bookings off-platform to avoid Club fees in violation of these Terms.
• Provide a safe environment and accurate information relevant to each booking.

7. Assumption of risk; release; limitation of liability

To the fullest extent permitted by law, you assume all risk arising from your use of the Service and from any interaction, booking, or childcare arrangement facilitated through it. You release the Club and its members, owners, and affiliates from any claims, damages, or liabilities arising from the acts or omissions of any Parent or Sitter. The Service is provided “as is” without warranties of any kind. The Club’s total liability for any claim relating to the Service will not exceed the fees you paid to the Club in the three months before the claim.

8. Indemnification

You agree to indemnify and hold harmless the Club and its members from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your bookings, or your breach of these Terms.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access at our discretion, including for violation of these Terms.

10. Governing law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules.

11. Changes

We may update these Terms from time to time. Material changes will be posted here, and continued use after they take effect constitutes acceptance.
