Liability Waiver & Release

This Waiver, Release, and Assumption of Risk (“Waiver”) applies to each parent or legal guardian (“you”) who uses The Sitters Club platform operated by The Sitters Club LLC (the “Club”). By agreeing to this Waiver when you join or book, you accept the following.

1. Nature of the service

The Club is a platform that introduces you to independent babysitters (“Sitters”). The Club is not a childcare provider and does not employ, supervise, or control the Sitters. Any Sitter you book is an independent individual, and you are choosing to entrust your child(ren) to that Sitter of your own free will.

2. Assumption of risk

You understand that childcare involves inherent risks, including the risk of injury, illness, or accident. You knowingly and voluntarily assume all such risks arising from any booking, interaction, or childcare arrangement made through the Club.

3. Your responsibilities

• You are responsible for interviewing and evaluating any Sitter and deciding whether to entrust your child(ren) to them.
• You will give the Sitter accurate information, including allergies, medical needs, emergency contacts, and household instructions.
• You authorize the Sitter to seek emergency medical care for your child(ren) if you cannot be reached, and you are responsible for any resulting costs.

4. Release and waiver

To the fullest extent permitted by law, you release, waive, and discharge The Sitters Club LLC and its members, owners, and affiliates (the “Released Parties”) from any and all claims, liabilities, damages, or expenses arising out of or relating to the acts or omissions of any Sitter or Parent, or to any injury, harm, or loss connected with childcare arranged through the Club, whether based on negligence of the Released Parties or otherwise, except to the extent such a release is prohibited by law.

5. Indemnification

You agree to indemnify and hold harmless the Released Parties from any claims brought by or on behalf of your child(ren) or arising from your use of the Service.

6. Governing law

This Waiver is governed by the laws of the State of Utah. If any part is held unenforceable, the remainder stays in effect.

By agreeing to this Waiver, you confirm that you have read it, understand it, and accept it voluntarily.
